Dear Sir/Madam,
I am writing to formally report Hotel Aldebaran in Lido di Jesolo, Italy, concerning what I believe to be misleading advertising and an unfair commercial practice regarding the accommodation that was advertised, booked and subsequently provided to my family.
Booking and advertised accommodation
We booked a “SUPERIOR Family Room with terrace” at Hotel Aldebaran for three nights, from 26 July 2026 until 29 July 2026.
The confirmed reservation price was €951.
This was specifically a SUPERIOR room and we were accommodated on the second floor of the hotel.
This is particularly important because Hotel Aldebaran explicitly advertised the following description to consumers:
“On first and second floor you can find SUPERIOR rooms which are completely renovated.”
We relied on this information when booking the accommodation. We therefore had every reason to expect that the Superior room provided to us on the second floor would indeed be a completely renovated room, as expressly advertised by the hotel.
The room provided did not correspond with this description
Upon arrival, it became immediately apparent that the room provided to us did not correspond with the condition advertised by the hotel.
The room had, among other things:
• damaged walls;
• peeling plaster;
• extensive black marks and stains on the walls;
• crumbs left in the room;
• a shower head heavily affected by brown limescale and dirt;
• cobwebs;
• spiders in several areas of the room.
We have photographic evidence documenting these conditions.
The condition of the walls in particular was completely inconsistent with the hotel’s explicit representation that the Superior rooms on the first and second floors were “completely renovated.”
This is not simply a matter of personal dissatisfaction or preference. We specifically purchased a room category advertised as SUPERIOR, on a floor for which the hotel expressly stated that these rooms were completely renovated, and the accommodation actually provided did not correspond with that representation.
Complaint made during our stay
I reported the problems directly to the hotel reception during our stay and gave the hotel the opportunity to resolve them.
The hotel subsequently claimed that an appointment had been made with me to return to reception at approximately 11:00 a.m. the following morning to view another room.
No such appointment was made with me.
I was never told that I was required to return to reception at 11:00 a.m. for an appointment.
Furthermore, I passed the reception numerous times the following morning. At no point did a member of staff approach me, remind me of an appointment or inform me that an alternative room was waiting for us.
The hotel nevertheless subsequently relied on this alleged appointment to argue that, because I supposedly did not attend, they assumed that the problems had been resolved.
Hotel’s response after our stay
After our stay, we formally complained to Hotel Aldebaran in writing and clearly explained the condition of the room and the problems we had experienced.
The hotel has therefore had several opportunities, both during and after our stay, to address the matter properly.
During the correspondence, the hotel acknowledged that there had been problems and eventually offered us a €100 credit towards a future stay at Hotel Aldebaran, valid for a future reservation.
We do not consider this an adequate solution.
It requires us to become customers of the same hotel again and spend money on another reservation before receiving any benefit from the proposed compensation.
Most importantly, this offer does not address the central issue: the accommodation that was sold and advertised to us did not correspond with what was actually provided.
Reason for reporting this matter to the AGCM
I am reporting this matter because I believe it goes beyond an individual dispute about the quality of a hotel stay.
Hotel Aldebaran advertised to consumers that the Superior rooms on the first and second floors are “completely renovated.”
We specifically booked a SUPERIOR Family Room with terrace, were accommodated on the second floor, and have photographic evidence showing the actual condition of the room we received.
There is therefore a clear and documented difference between the representation made to consumers and the accommodation actually provided to us.
Such information is capable of influencing a consumer’s booking decision. The description of a room as Superior and completely renovated is clearly relevant when a consumer decides whether to book that room and what price they are prepared to pay for it.
For this reason, I respectfully request that the Autorità Garante della Concorrenza e del Mercato assess whether Hotel Aldebaran’s presentation and advertising of these rooms constitutes misleading advertising and/or an unfair commercial practice under applicable Italian consumer protection law.
I also ask the Authority to consider whether other consumers may potentially be affected if rooms continue to be advertised in this manner while their actual condition does not correspond with the description.
Evidence
I am able to provide and/or attach extensive supporting evidence, including:
1. our booking confirmation showing the SUPERIOR Family Room with terrace;
2. confirmation of the €951 reservation price and dates of stay;
3. the hotel’s published description stating that Superior rooms on the first and second floors are “completely renovated”;
4. photographs showing the actual condition of the room;
5. photographs showing the cleanliness and maintenance problems;
6. our written complaint to Hotel Aldebaran;
7. the hotel’s written responses;
8. the hotel’s statement regarding the alleged 11:00 a.m. appointment;
9. the hotel’s subsequent acknowledgement of a misunderstanding in communication;
10. the hotel’s offer of €100 credit towards a future stay.
I respectfully request that the AGCM register this complaint and assess the conduct of Hotel Aldebaran under the applicable Italian consumer protection rules.
